Terms and Conditions for MyChart

Your Nephrology provider (Provider) is pleased to offer you access to MyChart — your electronic health record – hosted by DPS CKD LLC (DPS CKD EHR). By opening a MyChart account, you agree to be bound by the following Terms and Conditions. DPS CKD EHR may change these Terms and Conditions at any time and will post new Terms and Conditions on the MyChart website. New Terms and Conditions are effective as soon as they are posted.

By accessing or using your Provider’s MyChart, you request that medical information regarding your care and treatment be released to you through online access to MyChart. This authorization will remain valid unless/until it is revoked.

By your acceptance of these Terms and Conditions, you agree that you understand that this authorization may cover disclosure of information relating to ALCOHOL or DRUG ABUSE, GENETIC TESTING, PSYCHIATRIC CARE and/or CONFIDENTIAL HIV RELATED INFORMATION. In the event the medical information described below includes any of these types of information, you specifically authorize release of such information via MyChart. You have the right to cancel this release of information through MyChart at any time by contacting your Provider.

Urgent communications:

MyChart should never be used for urgent communications with your physician. If you have an urgent health concern, you should contact your physician office by telephone. If the issue is an emergency, call 911 or go to an emergency room.

System security: The security of your information is important to us. My Chart is accessed through a Secure Sockets Layer (SSL) compatible browser and the application utilizes 128 bit encryption to protect your information. You can tell when you are in secured areas of the site by looking at the URL in your browser window. If the URL begins with https:// then you viewing secured information.

In addition, you access MyChart using a unique user name and password. Your user ID and password are stored in an encrypted database. It is your responsibility to protect your password. If you share your password with others, they will have the ability to access your records.

E-mail privacy: Communications in MyChart are protected as described above. When you receive a MyChart message from your Provider, you will be notified through your personal e-mail account that you have a message waiting for you on MyChart. This means that any person with access to the e-mail you use to register with MyChart will be able to see this notification. This could include members of your family or anyone else that can access to your e-mail account. The notification that new medical information is available by accessing MyChart may be information that you may not want others to know. Thus, you should take this into account when providing an e-mail address or using MyChart.

Access to MyChart:

Generally: Access to MyChart is granted to persons age 18 or older who are patients at your Providers’ office or the office of other participating physicians who use the EPIC medical record system.

Proxy Access: In certain prescribed circumstances, individuals may obtain proxy access through MyChart to the health information of another patient by completing an access form for that purpose (provided by your Provider). Proxy access to a patient’s health information is granted pursuant to a legal relationship with the patient or the consent of the patient and is governed by these Terms and Conditions and the terms set forth on the applicable MyChart Proxy Access Form. MyChart Proxy Access Forms are available in your Provider’s office. As a proxy user you are required to access MyChart via your own MyChart account and associated MyChart ID. When you access MyChart as a proxy user, these Terms and Conditions apply to you.

  • Parents of minor children: Parents and legal guardians may request access to their minor child's health information through MyChart. This is a type of proxy access. The amount of information the parent will be able to see depends on the age and legal status of the minor. The limits on interactive health record access does not affect any other right the parent may have to obtain a minor child's records. For further information on medical records requests, please contact your Provider.
  • Persons with legal relationships to the patient: Persons who are court-appointed guardians, power-of-attorney, or designated health care representatives for incapacitated patients may request proxy access to a patient record. In all such cases, the requesting party must submit documentary proof of their appointment as guardian, power-of-attorney or health care representative to the patient’s Provider.

Discontinuation of Access: Your Provider reserves to itself the right to terminate a person's MyChart access at any time and for any reason. Some common reasons for termination include but are not limited to:

  • Death of the user
  • Prolonged period of inactivity of the MyChart account
  • Abuse of the account - For example, use of vulgar or threatening language in communications to the physician, or repeated attempts to communicate with a physician who has severed the physician/patient relationship.

Patients with a MyChart account who have granted proxy rights to one or more other persons have the ability within their own account to terminate the proxy access. DPS CKD EHR assumes no responsibility for a proxy's continued access to the account. If you are unable to terminate a proxy's access within your own account, you may contact your Provider’s office to request proxy access termination.

Medical record: The MyChart record is not a complete copy of your patient medical record. MyChart users and persons who do not have access to MyChart can obtain copies of their medical record by contacting their Provider.

Site availability: MyChart may become unavailable during periods of site maintenance and backup or in the event of a site crash. Access is provided on an ‘as available’ basis and DPS CKD EHR does not guarantee access at any time.

Limitations on Use of MyChart: You agree that you will not upload or transmit any communications or content of any type (including secure messaging and E-visit / Video Visit) that may infringe upon, misappropriate, or violate the law or the rights of any party. You agree that the following actions shall constitute a material breach of these Terms and Conditions:

  • signing on as or pretending to be another person
  • transmitting messages or material that infringes on or violates the intellectual property rights of others or the privacy or publicity rights of others
  • transmitting material that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person or entity
  • using MyChart’s interactive services in any way that is intended or is reasonably likely to harm the patient or others
  • intentionally distributing viruses or other harmful computer code

DPS CKD LLC expressly reserves the right, in its sole discretion, to terminate a user's access to MyChart due to any act that would constitute a violation of these Terms and Conditions.

Limitation of Liability

DPS CKD LLC AND ITS AFFILIATES, SUPPLIERS, AND OTHER THIRD PARTY BUSINESS PARTNERS ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO MYCHART, SITE-RELATED SERVICES AND PRODUCTS, CONTENT OR INFORMATION CONTAINED WITHIN MYCHART, AND/OR ANY THIRD PARTY WEB SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH MYCHART, SITE-RELATED SERVICES, AND/OR THIRD PARTY WEB SITES IS TO STOP USING THE WEB SITE AND/OR THOSE SERVICES. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Indemnity

You agree to indemnify, defend and hold DPS CKD LLC and our third party business partners and licensors and each of our and their respective affiliates, licensees, successors and assigns and our and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns, harmless from any claim, demand, liability, dispute, damage, cost, expense, or loss, including attorneys’ fees and costs of litigation, arising out of or in any way related to your violation of these Terms of Use or your access or use of this Site, the Content, your violation of these Terms of Use or your violation of any rights of another.

Use of Third-Party Services

You may choose to use other services provided by third parties in conjunction with your use of MyChart. Such services may include, but are not limited to, translation services, location services, and other third-party offerings. Any links to such services are provided for your convenience only. Neither Epic nor DPS CKD EHR have control over the contents of these services, and neither Epic nor DPS CKD EHR accept any responsibility for them or for any loss or damage that may arise from your use of them. Such services may require you to submit your information to a third party, which may result in a copy of your information being used and/or stored by a third party. If you decide to access any such services in conjunction with your use of MyChart, you do so entirely at your own risk and subject to the terms and conditions of use for such services.
